Terms of service

Article 1. Definitions

Terms and Conditions ("Conditions"): The conditions applicable to all sales via Succubus.com. By placing an order, you agree to these terms.
Company: Succubus B.V. ("Succubus.com"), an online store offering clothing and related items.
Consumer: A natural person or company entering into a distance contract with the company.
Agreement: A distance contract between Succubus.com and the consumer.

Article 2. Applicability

These conditions apply to every offer from Succubus.com and every distance contract between the company and the consumer.
The conditions are made available on our website before the agreement is concluded. By accepting an offer or placing an order, you accept these conditions.
Deviations from these conditions are only possible in writing. These deviations do not apply to future transactions.
Terms or conditions of third parties are not recognized unless otherwise agreed in writing.

Article 3. Agreements

An agreement is concluded after acceptance of your order by Succubus.com. The company may refuse orders or attach specific conditions to the delivery. Non-accepted orders will be communicated with reasons within five working days.

Article 4. Prices

All offers are non-binding, and prices may change, especially if required by legal regulations.
Prices include VAT and, for the Netherlands, Belgium, and Germany, include shipping costs. Total prices are communicated in advance.
Prices that are incorrect due to typographical or printing errors are not binding.

Article 5. Payments

Payment is made in advance and can be made using various methods as indicated during the ordering process. Specific payment terms may apply.
In the event of bankruptcy or suspension of payment, all claims are immediately due.
When outsourcing collection, collection costs of 15% of the principal amount are due, with room for demonstrably higher actual costs.

Article 6. Delivery

Products are shipped as soon as possible after ordering. Orders placed before 16:00 CET/CEST are shipped the same day, with delivery times dependent on the destination.
If an item is unavailable, the consumer will be informed as soon as possible, and the purchase amount will be refunded.
No right to compensation in case of exceeding the delivery period.
Partial deliveries are allowed. Delivery is complete as soon as a delivery attempt is made.
Costs for uncollected deliveries and the associated risks are borne by the consumer.

Article 7. Retention of Title

Ownership of products transfers to the consumer once full payment has been made.

Article 8. Exchange and Returns

Products can be returned within 14 working days of receipt, in accordance with the provided instructions.
Return shipping costs are borne by the consumer. In case of abuse of the right of return, Succubus.nl may impose sanctions. Read more in article 9.

Article 9. Protective Sanctions

We offer our customers the opportunity to return items within the legal return period, in accordance with our return policy. This right of return is intended to give customers the opportunity to evaluate a product as they would in a physical store.

Placing (large) orders with the intention of returning a substantial part of the items, or other behavior that leads to an excessively high number of returns, is considered improper use of this right.

Succubus reserves the right to take appropriate measures in such cases. These may include limiting or refusing future orders, temporarily or permanently blocking accounts, or adjusting the return conditions.

We ask for your understanding: only in this way can we maintain our service quality and keep our prices fair for all our customers.

Article 10. Complaints

Complaints must be reported immediately after receipt of the product via service@succubus.com.

Article 11. Liability

Succubus.com excludes all liability for indirect damage, unless there is intent or gross negligence.

Article 12. Force Majeure

In the event of force majeure, Succubus.com may suspend the execution of orders without obligation to pay compensation.

Article 13. Applicable Law

These conditions are governed by Dutch law.
